Core Care Provider Agreement

To Care Provider: 

Helpr Inc.’s (“Helpr”) Core Care service (the “Service”) is a referral program connecting Care Providers (“Care Provider,” “you,” “your”) with families looking to engage Care Providers (each, a “Family”) to provide care services (“Care Services”). In order to be eligible for potential consideration as a referral candidate through the Service, you acknowledge and agree as follows: 

  • Helpr is just an intermediary and does not engage you or have any legal obligations to you. As a Care Provider, you will be engaged directly by Families, not Helpr, and you are an employee of the Family that engages you. Helpr has no authority over the Families we work with, and you are under no obligation to accept positions with Families that extend to you an offer for employment. 
  • You and the Family that engages you are each able to terminate any employment relationship at any time and for any reason, and Helpr has no control over such termination by either party. 
  • Helpr advises each Family that receives the Care Services to (i) comply with applicable local, state, and federal laws and regulations in connection with their employment of Care Providers, and (ii) treat each Care Provider with respect, but Helpr has no control over, and assumes no responsibility or liability for, the actions of any Family or a Family’s failure to comply with such laws. 
  • The Family that engages you, and not Helpr, is responsible for paying you for the Care Services. Helpr is not responsible for any compensation, tax withholding or other tax liability, unemployment insurance, or other benefits or other employment-related obligations in connection with your employment by a Family. 
  • You represent and warrant that: (i) you are authorized to work in the region where you will work, (ii) you will comply with all applicable local, state, and federal laws and regulations when providing the Care Services, (iii) you meet all of the experience requirements included in the job posting for the position for which you submit an application, and (iv) any information you provide us and any Family is true, complete, and correct. 
  • You represent and warrant that: (i) you are authorized to work in the region where you will work, (ii) you will comply with all applicable local, state, and federal laws and regulations when providing the Care Services, (iii) you meet all of the experience requirements included in the job posting for the position for which you submit an application, and (iv) any information you provide us and any Family is true, complete, and correct. 

RELEASE.  I agree that each of Helpr, any Client’s Employer (as defined below) and any of their respective affiliates, subsidiaries, employees, directors, officers, shareholders, insurers and anyone acting on behalf of any of the foregoing (hereinafter the “Releasees”) shall have no responsibility or liability for any loss, delay, damage, personal injury, emotional distress, death, costs, fee or expenses of any type incurred by me or any third party in connection with my provision of Care Services. This release extends to any and all claims that may be made by me, or my spouse, child/children, family, estate, heirs, assigns, and anyone who might assert a claim on their behalf or on behalf of me.  “Client’s Employer” means any employer of a Family member that subsidizes such Family member’s access to the Service.
